RiverLease Violation Notice to Tenant

Notice of Lease Violation

[Landlord or management company name]
[Mailing address]
[Phone] | [Email]

[Date of this notice]

Delivered by [delivery method, e.g. hand delivery, first-class mail, certified mail or posting] to:
[Tenant's full name, and every other tenant on the lease]
[Rental property address and unit]

Dear [Tenant's name],

This notice is to let you know that you are not meeting a term of your lease dated [Lease date] for the property above. We want to resolve this and continue your tenancy. Please read this notice and take the steps below by the date given.

The lease term

Section [__] of your lease says:

"[Quote the lease clause exactly as written]"

What happened

[State the facts only: dates, times, what was seen or reported, and by whom. Leave out opinions and labels.]

  • [Date]: [What happened] ([Evidence, e.g. photo, written complaint, inspection note])
  • [Date]: [What happened] ([Evidence])
  • Earlier notices: [Dates of any earlier notices about the same issue, or "None"]

What you need to do

To correct this, please [Specific action, e.g. remove the second vehicle from the fire lane] no later than [Cure deadline: date and time].

[Give at least the time your lease and your state's law require. Some states set the cure period and the exact wording of a formal notice to cure. If you mean this letter to serve as that notice, use your state's required form and period instead.]

If the violation is not corrected

If the violation is not corrected by [Cure deadline], we may take further steps allowed by your lease and [State] law, which may include [e.g. the charge in Section __ of the lease, or a formal notice under the state statute that applies].

[List only steps your lease and state law allow.]

This notice does not end your tenancy and does not ask you to move out.

Questions, or if you disagree

If you believe this notice is wrong, or you need more time, please contact me by [Date] at [Phone or email]. If you need a change to a rule or policy because of a disability, you may ask for one, and I will consider it.

[If the issue involves an animal, a live-in aide or anything else that may relate to a disability, handle it as a possible accommodation request before treating it as a violation. If the tenant recently complained about repairs or contacted a housing agency, check your state's anti-retaliation rules before sending.]

Sincerely,

[Signature]
[Your name]
[Owner / Property manager], [Company]

Record of delivery

Delivered on [Date] at [Time] by [Method], by [Name of person who delivered it]. [Keep a copy of this notice and any proof of delivery, such as a mailing receipt or photo of the posted notice.]

How to write a lease violation notice

A lease violation notice is a landlord's letter telling a tenant which lease term they have broken and what to do about it by a set date. A good one quotes the clause, lists what happened with dates and evidence, names one fix and a deadline your state allows, and records how it was delivered. Unlike a notice to quit, it gives the tenant a chance to put things right and stay.

Decide first whether you are sending a friendly warning or your state's formal notice to cure, the step that can lead to ending the lease. In the US, state law sets the deadline, wording and delivery for the formal one.

Pick the right kind of notice

A broken lease term can call for three different letters, each with different legal weight. California's court self-help guide shows the split. A 3-day notice to perform covenants or quit1 covers a violation the tenant can fix, such as removing a pet or stopping noise. A 3-day notice to quit, with no chance to fix, covers serious problems like illegal activity.

Three letters for a broken lease term

LetterWhat it doesWho sets the rules
Warning letterAsks for a fix, and the tenancy goes onYour lease, plus some cities
Notice to cure or quitFix it by the deadline, or the lease can endState law: period, wording, delivery
Notice to quitEnds the tenancy for a serious or repeated violationState law

This template is a warning letter. Some California cities require a cease and desist letter1 before the formal notice, and the notice should then give the date you sent it. So write every warning as if a judge may read it. If you want the tenant to pay for a repair, a demand letter fits better.

Gather the facts first

Work from the signed lease, not your memory of it. Find the clause, note its section number and copy the exact words. Then record each incident: when it happened, what was seen or reported and by whom, and the proof, such as a photo or a neighbor's written complaint.

Keep labels out. "You never clean up" invites a denial. "Trash bags left outside unit 4 on June 2 and June 5 (photos 1 and 2)" is hard to argue with. Log each incident before you write to the tenant, the same way for every unit.

Check for a disability or a recent complaint

Notices about a dog, a parking space or a live-in helper can become a fair housing problem. HUD's rule makes it unlawful to refuse a reasonable accommodation in rules or policies2 that a person with a disability may need to use and enjoy their home equally. Its two examples are a seeing eye dog in a no-pets building and a reserved parking space near the unit for someone who can't walk far.

Check the timing as well. In Florida, a tenant who complained in good faith to a building, housing or health code agency can raise retaliation as a defense to eviction3. The defense fails if the landlord proves good cause, such as a genuine lease violation. A court can find retaliation only if the tenant was treated differently, which is where an even-handed log helps.

If a tenant asks for an exception

Pause the notice and consider the request first. Write down what was asked and how you answered, and get advice before you refuse.

Set a deadline the law allows

For a first warning, pick a date by which the fix is realistic. A car can move tonight, while a pet takes longer to rehome. If you mean the letter to be your state's formal notice, the statute sets the minimum.

Time to fix a violation under a formal notice, in four states

StateTime to fixWhat the notice must also do
California3 days, not counting weekends or court holidays1Describe the problem and say: fix it or move out
Florida7 days from delivery4Follow the statute's wording
WashingtonAt least 10 days after service5Name the breach and say the tenancy ends if it isn't fixed
OregonAt least 14 days after delivery6Describe one possible fix and set an end date at least 30 days out

Checked in October 2026. Oregon's section, ORS 90.392, allows a shorter date for a one-off act that has stopped. Week-to-week tenancies, city rules and other states differ.

Count carefully. California's courts say not to count the day of delivery or mailing7. A deadline that lands on a weekend or court holiday moves to the next court day.

What to put in a lease violation notice

  1. Address every tenant

Name each adult on the lease, add the property address and date the notice.

  2. Quote the clause

Give the section number and exact words, so any dispute is about the lease itself.

  3. List what happened

One line per incident, with its date and evidence, plus any earlier notices.

  4. Ask for one fix

Name a single action and a deadline, with a date and time anyone could check.

  5. Say what may follow

Only steps your lease and state law allow, and in a warning, that the tenancy continues.

  6. Invite a reply, then sign

Give a contact and a reply-by date, say the tenant may ask for a disability accommodation, and sign it.

ExampleA parking warning, written outAn illustrative example written for this guide

The lease term: Section 14(c) says, "Park only in the space assigned to your unit, and keep the fire lane clear at all times."

What happened: On March 3, 5 and 9, 2026, the gray SUV registered to your unit was parked overnight in the fire lane outside Building B. The site manager's photos 1 to 4 show each night, and a neighbor complained in writing on March 9.

What you need to do: Move the SUV to space 12 by 6 p.m. on Friday, March 13, 2026, and park only there.

This notice does not end your tenancy. If you think it is wrong, call or email me by Thursday, March 12.

  • The lease's own words. Quoted, so nobody argues about what the lease says.
  • Proof for each date. Every night has its evidence, and the photographer is named.
  • A fix anyone can check. On Friday evening, the SUV is in space 12 or it isn't.

Deliver it, log it, follow up

Deliver it in a way you can prove. California's courts list three ways to deliver a formal notice7. Hand it over, leave it with another adult at the home or workplace and mail a copy, or post it on the home and mail a copy. The person who delivered it signs a dated record.

Then log the delivery date and the deadline, and check back when the deadline arrives. If the problem returns, those dates decide what you can do next. In Florida, a similar violation within 12 months of a written warning4 lets the landlord end the lease without another chance to fix it. Oregon removes the right to cure for a repeat within 6 months6 of a formal notice.

Keep the log past move-out. If the violation damaged the unit, the same dated evidence can support a deduction in your security deposit itemization letter.

Before you send it

  • The clause is quoted exactly, with its section number
  • Every incident has a date and evidence
  • There is one fix, with a deadline your lease and state allow
  • You've checked for a possible disability or a recent complaint
  • It says the tenancy continues, unless it is your formal notice
  • The incident and the notice are in your log

When to bring in a lawyer

Have a local landlord-tenant lawyer review the letter before you send a formal notice to cure or quit, or once the tenant has a lawyer. California's courts warn that a notice with mistakes or missing information could cost you the case1. This guide is general information, not legal advice.

If you'd rather not start from a blank page, River's landlord letter generator drafts this notice and the log from your lease and photos. It runs in the box at the top of this page.

How to use this template

Fill in the files yourself, or let River draft them. Describe the problem in the box at the top of this page, pick the property's state and attach the lease and any photos or earlier notices. River looks up that state's notice rule on an official source, then fills in the log and the notice from your records.

Anything it couldn't confirm is marked for you to check. It keeps the letter a notice to correct and raises a possible disability or recent repair complaint before anything else. Nothing goes to your tenant until you review the draft and deliver it yourself.

  1. Download it or open it in River

Get the Word notice and CSV log free with no account, or start in River from the box at the top.

  2. Log the incident first

Add a row to the Violation and Notice Log with the date, the clause, the evidence and who reported it.

  3. Draft the notice

Quote the clause, list the facts by date and set one fix and deadline, or ask River to draft it.

  4. Deliver it and follow up

Deliver it in a way your state accepts, log the date and method, and check on the deadline.

Common questions

What should a lease violation notice include?

A lease violation notice should include the date, the name of every tenant on the lease, the property address and the lease clause quoted with its section number. Then list each incident with its date and evidence, and one fix with a deadline. Close with what may happen next, how to reply, your signature and a record of delivery.

How long does a tenant have to fix a lease violation?

A tenant's time to fix a lease violation depends on the state and on whether you send a formal notice to cure. Florida's statute gives 7 days, Washington's at least 10 and Oregon's at least 14, while California's formal notice allows 3 days not counting weekends or court holidays. For an informal warning, choose a deadline the tenant can actually meet.

Is a lease violation notice the same as an eviction notice?

No. A lease violation notice asks the tenant to correct a problem and keeps the tenancy going. Eviction is a court case, usually filed only after a formal notice that follows your state's rules has run out. If a tenant ignores your warning, read your state's statute or ask a local lawyer before the next step.

How should I deliver a lease violation notice?

Deliver a lease violation notice in a way your lease and state law accept, and keep proof. Methods vary by state. Florida's statute allows mailing, hand delivery or, if the tenant is away, leaving a copy at the home. Florida accepts email only if you both signed a lease addendum agreeing to it. Record the date, method and who delivered it.

What if the tenant says the pet is a support animal?

Treat it as a possible request for a reasonable accommodation, not a violation, until you have looked into it. Federal fair housing rules can require an exception to a no-pets policy for a tenant with a disability. Keep a written record of the request and your answer, and get legal advice before you refuse.

Is this lease violation notice template free?

Yes. Download the Word notice and the CSV log with no signup, from the link under the box at the top. They open in Word, Google Docs, Excel or Google Sheets. Describing your situation in the box opens the same template in River, which is free to start and drafts it from your records.

What does River do when I use the box at the top?

River reads what you type and attach, such as the lease, photos and earlier notices, and asks a follow-up only if a key fact is missing. It looks up your state's notice rule, fills in the notice and the log, and marks anything it couldn't confirm. It only drafts: nothing reaches your tenant until you deliver it yourself.
